Family Law

Divorce

We will provide advice and assistance in relation to the Divorce process. We will advise you on what separation actually means and will give you advice as to whether you have actually separated under the Family Law Act 1975 Cth.

As it is a legal requirement in Australia to have been separated for over 12 months prior to applying for a Divorce Order, we will explore with you the possibility of any counselling prior to applying for a divorce, particularly if children are involved as this will ease the process for the both of you.

We will lodge the Divorce application on your behalf and once lodged, ensure that it is served on the other party. We will also attend the divorce hearing and be there until the end of the journey, when the Divorce Order is granted.

Purchase

At Khalil Lawyers, we can assist with all your property purchase matters. Whether you are a first home owner wanting to purchase a property for the first time, or whether you are a regular investor in the market, we have setup a diligent 5 step process to help ensure the process is smooth for you.

Our 5 step to step process to a property purchase is as follows:

We first contact you to have an initial discussion with you to understand your requirements when purchasing the property.

We then conduct an extensive review of the contact. We review the special conditions and assess the Certificate of Title to determine whether there are any restrictions or limitations that may affect your desired intention with the property. We contact Council on your behalf and any other government body to make sure that we have you covered when it comes to the property;

After an extensive review of the contract, we provide you with our detailed letter of advice and have a sit down conference with you to ensure that all your questions are answered. During this time we make with your broker to ensure that you have the financial means to purchase the property

Once you are 100% happy to proceed with the purchase, we liaise with the agent and the Vendor’s solicitor to navigate exchange.
Following exchange we get the file ready for settlement and attend to settlement.

As we have experience in property purchases in other jurisdictions in Australia, we make sure that you understand the difference and your contractual obligations in those other states.

Sale

At Khalil Lawyers, we assist you when it comes to selling your property. We ensure that all your concerns are covered in the Contract of Sale, and have developed a 4 step process to guide you through the sale process.

Our 4 step to step process to a property purchase is as follows:

We first contact you to have an initial discussion with you to understand your requirements when selling your property. During this time we find out the specific Special Conditions you require inserted in the Contract to protect you.

We then prepare the Contract of Sale and liaise with the Agent in respect of any prospective purchasers.

We facilitate exchange with the Purchases solicitor.

Following exchange we get the file ready for settlement and attend to settlement.

Leases- Residential

Residential Leases in NSW are covered under the Residential Tenancies Act NSW 2010.

At Khalil Lawyers we can assist in all your residential leasing enquiries. We can provide advice and guidance when it comes to placing your property for Lease or if you are a tenant, wanting advice in respect of your rights and obligations under the Lease.

Easements

Easements are an important factor that may affect your intentions with the property, whether you are intending to knock down and rebuild your dream home and later find out you do not have the authority to access a particular part of the land, or whether your neighbour needs a right of way through your property.

Wills & Estates

At Khalil Lawyers, we understand that Will and Estate planning can be a difficult issue to discuss with family members and yourself. This is why we have made it our prerogative to be there by our clients side when it comes to Will and Estate planning.

Wills

When it comes to talking about your Will, we take the time to understand your family structure and answer any question that you have in respect of the preparation and finalisation of your Will.

We will explain to you the roles of Executor and Trustee and ensure that you have selected the right person or persons to engage in those roses.

When it comes to how your estate will be divided, we will advise you of the different types of options you have, whether you are wanting to setup a Testamentary Trust for a beneficiary or whether you are happy to make a direct distribution.

We will also include any wishes and directions you have that you wish to be recorded in the Will.

Once the Will has been finalised and signed by you, we will place your original Will in our Safety Deposit box to ensure that it has been safely stored for future use by the Executors.

Probate/Letters of Administration

Khail Lawyers can also assist in all court applications for Probate and/or Letters of Administration.

We will prepare all the required paperwork to be lodged with the NSW Supreme Court and work with the Executors to ensure that there are no issues when dealing with the Estate.

If required, we will also assist with the preparation and drafting of any Deeds of Family Arrangements that may be needed should the beneficiaries come up with an alternative arrangement for the disposition of property under the Will.

Following the Court granting the Probate and/or Letters of Administration over the Estate, Khalil Lawyers will work with the Executors in respect of the distribution of the Estate.

Family Provision Claims

At Khalil Lawyers we understand that sometimes persons are left out of the Will, particularly if they are family members or someone that has been in a position of care for the deceased.

If you have been in this situation, Khalil Lawyers can provide you with advice as to whether you are eligible to make a Family Provision Claim under Chapter 3 of the Succession Act 2006 (NSW).
